Risk disclosure
Trading futures, options, forex, cryptocurrencies and other leveraged instruments involves substantial risk of loss and is not suitable for every person. Leverage means you can lose more than your initial deposit. You should only trade with money you can afford to lose, and you should consider whether trading is appropriate for you in light of your experience, objectives and financial situation.
No advice. Kairos is a technical analysis and education tool. Nothing provided by Kairos, including the indicator, signals, grades, alerts, position size suggestions, website, guide or any communication, is financial, investment, tax or trading advice, or a recommendation to buy or sell any instrument. You alone are responsible for your trading decisions.
Hypothetical performance. Hypothetical or simulated performance results, including backtests, Strategy Tester reports and on-chart statistics, have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because the trades have not been executed, the results may have under- or over-compensated for the impact of market factors such as lack of liquidity, slippage and fees. Simulated trading programs are also designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
Past performance is not indicative of future results. Market conditions change, and a method that worked in the past may not work in the future.
Technology risk. Alerts and webhooks depend on TradingView, your internet connection and third-party services. They may be delayed, duplicated or fail. Do not rely on them as your only means of managing a position.
Illustrations. Charts and examples on this website are illustrative and do not show real trades or results.
Terms of service
These terms govern your use of Kairos, provided by [account holder's full legal name] trading as Kairos, New Zealand ("we", "us"). By purchasing or using Kairos you agree to them.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live if that's higher, and legally able to enter into this agreement.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to use Kairos on the TradingView account you register with us, for the duration of your subscription (or indefinitely for lifetime purchases, while we continue to operate the product). You may not share, resell, copy, reverse-engineer or redistribute Kairos or its signals, or give others access to your account for that purpose.
3. Access and TradingView
Kairos is delivered as an invite-only script on TradingView, a third-party platform we don't control. Your use of TradingView is subject to its own terms. We aren't responsible for TradingView outages, changes or account restrictions.
4. Payments and billing
Payments are processed by Whop. Prices are in US dollars, and any applicable taxes are shown at checkout. Access is delivered to your TradingView username within 24 hours of purchase. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime from your Whop account, and access continues until the end of the paid period. We'll give at least 30 days' notice of any price change before it applies to your next renewal.
Founding-member pricing. Subscriptions started at the founding-member price keep that price for as long as the subscription stays active without interruption. If you cancel and later re-subscribe, the price at that time applies.
5. No guarantee of results
We work hard to keep Kairos accurate and available, but we don't promise it will be error-free or uninterrupted, or that it will produce any particular trading result.
6. Limitation of liability
To the extent permitted by law, we are not liable for any trading losses, lost profits, or indirect or consequential losses arising from your use of Kairos. Our total liability is limited to the amount you paid us in the 12 months before the claim.
7. Your consumer rights
If you're a consumer in New Zealand, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you're elsewhere, you keep any consumer rights that your local law says can't be excluded.
8. Termination
We may suspend or end your access if you breach these terms, including by sharing or reselling access. In that case no refund is given.
9. Changes to these terms
We may update these terms from time to time. We'll change the "last updated" date and, for significant changes, let customers know by email.
10. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.

Privacy policy
We follow the New Zealand Privacy Act 2020. This policy explains what we collect and why.
What we collect
- Account details: your name, email and TradingView username, collected at checkout so we can deliver access and support.
- Payment details: handled by Whop. We never see or store your full card number.
- Website analytics: we use Plausible, which measures visits without cookies and without collecting personal information, so you won't see a cookie banner on this site.
How we use it
To grant and manage your access, provide support, send important product and billing emails, and, if you opt in, send product updates. We don't sell your personal information.
Sharing and storage
We share information only with the service providers that help us run Kairos: Whop (payments and access), TradingView (so access can be granted to your username), our email provider and our website host, or where required by law. Some of these providers store data outside New Zealand, including in the United States. We use providers with comparable privacy safeguards.
Your rights
You can ask to see or correct the personal information we hold about you, or ask us to delete it, by emailing support@kairosindicator.com. If you're not happy with how we handle your request, you can complain to the Office of the Privacy Commissioner (privacy.org.nz).
Retention
We keep your information while you're a customer. Afterwards we keep purchase records for up to 7 years, as New Zealand tax law requires, and delete the rest.
Refund policy
Delivery guarantee. If we haven't delivered access to your TradingView username within 24 hours of your purchase, email us and we'll refund you in full.
All sales are final once access is delivered. Kairos is a digital product, so once access has been delivered we don't offer refunds or credits for change of mind. This applies to monthly, yearly and lifetime purchases and to renewals. You can cancel a subscription anytime to stop future charges, and you keep access until the end of the period you've paid for.
Trading results. Refunds aren't given based on trading results or losses.
If something's wrong. If Kairos doesn't work as described, for example you never receive access, email support@kairosindicator.com and we'll fix it. This policy doesn't affect your rights under the Consumer Guarantees Act 1993 or any consumer law that applies to you.
